Effective Date: September 2, 2026 · Last Updated: September 2, 2026
These Terms and Conditions (“Terms”) govern your access to and use of the BGV Homecoming website, registration system, attendee platform, matching and networking features, text-message program, and related digital services, as well as your registration for and participation in BGV Homecoming events, programs, entertainment, wellness activities, and experiences (collectively, the “Services”).
The Services are provided by BGV Foundation (“BGV,” “we,” “us,” or “our”). By creating an account, registering for an event, purchasing or accepting a ticket, accessing the platform, or participating in BGV Homecoming, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 18 years old and legally capable of agreeing to these Terms, or you must participate with the authorization and supervision of a parent or legal guardian. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
You agree to provide accurate, current, and complete registration and profile information and to update it when necessary. You are responsible for protecting your login credentials and for activity conducted through your account.
Registrations, credentials, tickets, and attendee accounts may not be transferred, resold, duplicated, or shared unless BGV expressly permits it. We may request identification or other reasonable information to verify a registration or protect the security of the Services.
Refund requests for BGV Homecoming registrations must be received by BGV before September 8, 2026. Beginning September 8, 2026, all registrations are nonrefundable. To request a refund before the deadline, email contact@bgvfoundation.organd include the registered attendee’s name and the email address used for the registration. Approved refunds will be returned to the original payment method when reasonably practicable.
Ticket prices, payment terms, transfer rules, and any additional cancellation terms disclosed during purchase or in a separate written event policy are incorporated into these Terms. If an additional policy conflicts with the refund deadline above, the refund deadline above controls unless BGV expressly states otherwise in writing.
You agree to pay all charges presented and authorized at checkout. Payment processing may be handled by a third-party provider subject to its own terms and privacy policy.
Unless BGV states otherwise in writing, BGV is not responsible for attendee travel, lodging, transportation, meals outside the event program, or other personal expenses. If BGV cancels an event, any refund or credit will be handled under the policy communicated for that event and applicable law.
Event schedules, speakers, performers, sessions, venues, formats, benefits, and platform features may change due to availability, safety, operational needs, circumstances outside BGV’s control, or other reasonable causes. BGV may substitute comparable programming or change an in-person component to a virtual or hybrid format when reasonably necessary.
BGV will provide notice of material changes when reasonably practicable. A change to a particular speaker, performer, session, schedule, or platform feature does not by itself guarantee a refund unless the purchase policy or applicable law provides otherwise.
The platform is intended to support registration, event communications, personalized attendee experiences, professional networking, and community connection. You may use it only for lawful, event-related purposes.
You may not:
The platform may recommend connections based on profile information, interests, goals, industries, or other registration responses. Matches are suggestions only. BGV does not promise any particular match, introduction, business result, funding outcome, partnership, investment, employment opportunity, or professional relationship.
BGV does not independently verify every statement made by an attendee. You are responsible for deciding whether, when, and how to communicate, meet, exchange information, or conduct business with another attendee. Conduct appropriate due diligence before entering any financial, professional, or personal arrangement.
You may use information made visible to you through the attendee platform only for respectful, individual, BGV Homecoming-related networking. Access to the attendee directory does not authorize you to add attendees to marketing lists or share their information with others.
BGV Homecoming is intended to be a respectful, inclusive, and professionally supportive environment. You agree to treat attendees, staff, volunteers, speakers, performers, vendors, and venue personnel with respect and to follow reasonable event, venue, health, safety, and security instructions.
Prohibited conduct includes harassment; discrimination; threats; violence; unwanted sexual attention; stalking; intimidation; disruptive behavior; possession of unlawful weapons or substances; unsafe conduct; unauthorized solicitation; and conduct that materially interferes with another person’s participation or the operation of the event.
BGV may deny entry, restrict platform access, remove a participant, revoke credentials, or contact venue security or law enforcement when BGV reasonably believes action is necessary to protect people, property, the community, or the Services. Where permitted by law and the applicable refund policy, removal for a violation of these Terms may occur without a refund.
Concerns may be reported to BGV staff at the event or to contact@bgvfoundation.org.
Some BGV Homecoming programming may include breathwork, meditation, movement, sound, or other wellness activities. Participation is voluntary. These activities are educational and experiential and are not medical care, diagnosis, psychotherapy, or a substitute for advice from a qualified healthcare professional.
You are responsible for choosing activities appropriate for your health and circumstances. Consult a qualified healthcare professional before participating if you are pregnant, have a medical or mental-health condition, have concerns about physical activity or breath practices, or are unsure whether an activity is appropriate for you. Stop participating and seek assistance if you feel pain, faintness, significant distress, or other concerning symptoms.
You should disclose only the minimum information reasonably necessary when requesting an accommodation. BGV will make reasonable efforts to address timely accommodation requests but cannot guarantee that every request can be fulfilled.
BGV may share dietary restriction information with caterers, venues, and other providers as reasonably necessary to support your request. Although we will make reasonable efforts to communicate requests, BGV cannot guarantee that food will be free from a particular ingredient, allergen, or cross-contact. If you have a serious allergy or medical dietary need, notify BGV in advance, speak directly with food-service personnel, review available ingredient information, and use your own judgment before consuming food or beverages.
BGV Homecoming may be photographed, livestreamed, or recorded by BGV or its authorized representatives. Images and recordings may capture attendees individually or as part of a group and may be used to document, report on, promote, or communicate about BGV and BGV Homecoming in print, digital, social, educational, archival, and promotional materials.
BGV will make reasonable efforts to communicate available procedures for attendees who prefer not to be featured in identifiable close-up photography or interviews. Contact us before the event or speak with event staff upon arrival. Because BGV Homecoming is a live event, we cannot guarantee that an attendee will never appear incidentally in crowd or background footage. Any separate written appearance, speaker, performer, or media release you sign will control if it conflicts with this section.
Attendees may not record private conversations, restricted sessions, performances, or another attendee in a manner that violates law, posted rules, intellectual-property rights, or a reasonable expectation of privacy.
You retain ownership of content you submit to the platform. You give BGV a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and use that content only as reasonably necessary to operate, secure, improve, and provide the Services and as described in the Privacy Policy. This license ends when the content is deleted from active systems, except for reasonable backup, legal, reporting, or recordkeeping needs.
You represent that you have the rights necessary to submit your content and that it does not violate another person’s rights or applicable law.
If you voluntarily provide ideas, suggestions, or feedback about the Services, BGV may use that feedback without restriction or compensation, provided BGV does not publicly identify you as the source without permission.
The Services—including BGV names, logos, event branding, platform design, text, graphics, videos, session materials, compilations, and software—are owned by or licensed to BGV and are protected by intellectual-property laws. Except as expressly allowed, you may not copy, reproduce, modify, distribute, sell, license, publicly display, create derivative works from, or commercially exploit BGV content without written permission.
BGV grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for your personal participation in BGV Homecoming. No other rights are granted.
Speakers, performers, sponsors, exhibitors, and attendees retain rights in their own names, likenesses, materials, presentations, products, and intellectual property.
BGV Homecoming may include sponsors, funders, exhibitors, speakers, venues, vendors, or links to third-party services. Their participation does not necessarily constitute BGV’s endorsement of their products, advice, statements, or services. Your interactions or transactions with third parties are between you and the third party and may be governed by separate terms and privacy policies.
Program Description
The BGV Homecoming messaging program provides registered attendees who affirmatively opt in with event-related customer-care communications. Messages may include schedule reminders and changes, location and check-in information, logistical or safety updates, event notices, and responses to attendee questions. Messaging will primarily occur before and during the BGV Homecoming event period.
Consent and Eligibility
SMS consent is optional, is collected separately from general registration acceptance, and is not a condition of purchasing a ticket, registering, attending, or participating. By opting in, you confirm that you are the subscriber or customary user of the mobile number provided and authorize BGV to send event-related text messages to that number, including through an automated system where applicable.
Message Frequency and Charges
Message frequency varies and may increase during the event period. Message and data rates may apply according to your mobile plan. BGV does not charge a separate fee for the messaging program.
Opting Out and Assistance
Reply STOP to unsubscribe. We may send one final message confirming your opt-out. Reply HELP for assistance, email contact@bgvfoundation.org, or visit www.bgvfoundation.org. You may opt in again through an authorized BGV opt-in method.
Delivery and Carriers
Delivery is subject to effective transmission by your wireless carrier and is not guaranteed. Carriers are not liable for delayed or undelivered messages. Supported carriers and program availability may vary.
Privacy
Our collection and use of information through the messaging program are governed by the BGV Homecoming Privacy Policy. Mobile phone numbers, SMS opt-in data, and messaging consent will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes.
Our collection and use of personal information are described in the BGV Homecoming Privacy Policy, which is incorporated into these Terms. If these Terms conflict with the Privacy Policy regarding the collection, use, or disclosure of personal information, the Privacy Policy controls.
BGV may suspend or terminate access to some or all Services if you violate these Terms, create a safety or security risk, misuse attendee information, or interfere with the event or platform. You may stop using the platform at any time and may request account deletion as described in the Privacy Policy, subject to information BGV must retain for legitimate legal, financial, security, or recordkeeping purposes.
Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, indemnification, and dispute provisions—will survive.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” BGV DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BGV DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR AVAILABLE AT ALL TIMES, OR THAT EVENT CONTENT, MATCHES, ADVICE, OR INFORMATION WILL PRODUCE A PARTICULAR RESULT.
Nothing in the Services constitutes legal, tax, investment, medical, or other regulated professional advice. You are responsible for obtaining advice appropriate to your circumstances.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BGV AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, AND EVENT REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, OPPORTUNITY, OR GOODWILL; OR DAMAGES ARISING FROM THIRD-PARTY CONDUCT, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BGV’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID BGV FOR THE APPLICABLE BGV HOMECOMING EVENT OR SERVICE DURING THE 12 MONTHS BEFORE THE CLAIM OR (B) $100.
These limitations do not apply to liability that cannot lawfully be excluded or limited, including any rights available to you under applicable consumer-protection law.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless BGV and its directors, officers, employees, volunteers, and agents from third-party claims, damages, liabilities, judgments, losses, and reasonable costs arising from your unlawful conduct, your material violation of these Terms, your misuse of attendee information or the Services, or content you submit that infringes another person’s rights. This obligation does not apply to the extent a claim results from BGV’s own negligence, willful misconduct, or violation of law.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Before filing a legal claim, you and BGV agree to make a good-faith effort to resolve the dispute informally. Send a written description of the issue and requested resolution to contact@bgvfoundation.org. If the dispute is not resolved within 30 days after receipt, either party may pursue available legal remedies.
Unless applicable law requires a different location, legal proceedings relating to these Terms or the Services may be brought in the state or federal courts located in Los Angeles County, California, and each party consents to their jurisdiction and venue.
BGV may update these Terms to reflect changes to the Services, event operations, or legal requirements. The revised Terms will be posted with an updated date. We will provide additional notice when a change is material and legally required. Changes will apply prospectively unless applicable law permits otherwise.
These Terms, the Privacy Policy, the ticket terms presented at purchase, and any additional terms expressly accepted for a particular activity constitute the agreement between you and BGV concerning the Services.
If a provision is found unenforceable, it will be modified only to the extent necessary, and the remaining provisions will remain in effect. BGV’s failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without BGV’s written consent. BGV may assign these Terms in connection with an organizational restructuring, merger, transfer, or similar transaction. Section headings are for convenience only.
